Approved defendants, who have voluntarily entered a Plea of Guilty to a minor misdemeanor traffic citation issued within the jurisdiction of the Dayton Municipal Court, may have their cases dismissed by the Court upon successful completion of the TSP and payment of the non-refundable $175.00 program fee. In this case, no points will be added to the defendant's driving record.

Eligible defendants have an opportunity to attend an online program with Safe Driver Online (SDO). The SDO program costs an additional $29.95. The class will provide helpful driving tips on a variety of topics related to the safe operation of a motor vehicle. The Prosecutor's Office will review each minor misdemeanor traffic case individually to determine eligibility for the Traffic Safety Program. The minimum criteria for participating in the Traffic Safety Program are:

• A two-point minor misdemeanor traffic violation with no accompanying criminal charges
• The traffic case does not involve an accident or property damage
• A valid driver's license at the time of the plea

THE STEPS OF THE TRAFFIC SAFETY PROGRAM

1. Defendant requests to be screened to the Traffic Safety Program
2. Court officials will review your case and driving record. Defendant is referred for the Traffic Safety Program if eligible
3. Defendant will receive a telephone call from the Court about their eligibility and receive further instructions
4. Defendant is advised of the terms and conditions of the Traffic Safety Program
5. Defendant signs a form agreeing to participate in the Traffic Safety Program
6. The Court Stays defendant's Sentence of Fines and Costs
7. Defendant pays any warrant fees and the $175.00 Traffic Safety Program fee within 30 days
8. After paying the TSP fee, Defendant will be given instructions on how to complete the Safe Driver Online program
9. Defendant completes the SDO program within 30 days
10. Safe Driver Online notifies Court of defendant's successful completion of TSP class
11. The Court dismisses defendant's traffic case

WARNING: NO CONTINUANCES WILL BE ACCEPTED AND NO REFUNDS WILL BE GIVEN if the online class is not completed within the 30-day time frame. THE $175.00 TSP FEE IS NON-REFUNDABLE.

CONDITIONS RESULTING IN A FAILURE TO COMPLETE THE TRAFFIC SAFETY PROGRAM:

• Defendant fails to pay the $175.00 Traffic Safety Program fee within 30 days
• Defendant fails to signup for the SDO class
• Defendant signs up for the SDO class, but fails to complete it within 30 days

CONSEQUENCES OF FAILING TO COMPLETE TRAFFIC SAFETY PROGRAM

• Stay is lifted and Sentence of $150 Fine and Court Costs remains in effect
• Conviction will be forwarded to the Bureau of Motor Vehicles, where points may be added to the defendant's driving record
• Clerk sends $150 Fine and Court Costs to collection and assesses $10 processing fee
• If $175.00 TSP fee was paid, it is forfeited. Court suspends $140 of the $150 Fine, leaving a Fine of $10 and Court Costs, which are sent to collection. $10 processing fee is assessed
